we have considered filing chapter 7 bk for a few months now, but have not done so due to the legal costs.
we listed our house for sale, thinking that we would sell it, and then file chapter 7. my question is.....how long after selling my house can i file without losing the equity. i have about 25k in equity , but my debt is well over 30k. most of the equity would be eaten up by real estate fees , moving expenses. a 5k lean, and the money needed to find a rental (1st last & sec ) to move to.
we're really in a tight spot and would appreciate any advise you can give.

I also live in Fla. and just filed today!

We used a paralegal service....they did everything for $175. That included the original and 4 copies and the disk. Much cheaper than a lawyer and from everyone else I spoke with it's a waste of $$$ to hire a lawyer. The paperwork was relatively simple, our mtg. of creditor was scheduled for one mth from today. Why are you selling your home, you do realize that you can keep your house in Fla. bankruptcy, dont you? Any money that you make from the sale will be taken by the courts to satisfy your debts, so maybe you should reconsider selling until after you file and everything has been discharged. Just a thought.....
