My husband and I have separated. I am the only one with an income. I have done my best to pay all the bills...I have even went through debt con. They keep raising my payment every month. I can no longer afford these payments. He has agreed to file bankruptcy also. Do we file together or apart? most of our debts are joint accounts. I have a vechile in my name, which I would like to reaffirm the debt. He has a vechile in both our names he wants to reaffirm the debt with that. I also have a vechile that a friend has took over the payments on. he has been making the payments for 1 year. What happens to this vechile? I have no assests that could be sold for the backruptcy. Any advice would be appreciated.

If you are still married you can still file jointly. It will probably save you money on filing fees. Depending on your personal situations you can file a 7 or a 13. It sounds like a 7 may be your best bet. You have the option of reaffirming on the vehicles, however the third you may not have that option on. It may have to be surrendered or see if they can refinance it in their name.
