We live in California...My mother charged up and maxed out all "her" credit cards years ago...she has a credit manager and is getting nowhere on paying them off. She is on limited income. She is still married, can she file bankruptsy alone without my dad being on the bankruptsy? Every credit card is in her name only.



similar situation i was in - just in case you don't get a response i was responded with this "any debt incurred while you are married is considered joint" - should your mom file bankruptcy the credit card company can run after your dad - too bad i too wanted to keep my husband's record clean!
