Baseball team hit my truck, who is at fault?

Yesterday, my Truck's windshield was hit by a foul ball. When I parked my car on the side street (a public street), I was not aware that any practice was going on nor was I told that any practice was going to happen. There are no signs on the street that says that I am parking at my own risk or anything. Do I have a case against the board of education? The coach said that it isn't their fault at all. I called the board of education and am awaiting their response which will most likely come on Monday.

By the way, I am a senior at this High School and it was the High School's baseball team that hit my car. The coach already admitted that it was one of his players that did it. No names were given or anything.

Edit - Another question. Why is it not their fault? I want a why behind it other than just the "it's not their fault" routine. The way I'm thinking of it is that if I go into the middle of a street, throw a baseball in the air and if it accidentally hits a car it isn't my fault. I didn't "intend" to hit a car, but I did.

No, it's not their fault. They do not have to notify you of their practices. Could you NOT see the baseball field??? Why didn't you park somewhere else???

makesmewannagag is a PERFECT handle for that guy!

Submit a claim for the cost of the repairs that will be required to fix your vehicle. Submit it DIRECTLY to the school with a certain time frame for a response (10 days would be fair). After that, if you haven't received a reply, move up to the district level.

So far the police have documented that the baseball hit my car so I have proof there. I am planning on getting my truck fixed tomorrow morning which will cost $232.21. Should I take pictures of the damage so I have it documented?

And do you think the school is at fault or not? I want to make sure that they are at fault before I take any action.

Do *I* think they're responsible for the damages? Heck yeah! BUT - it really doesn't matter now, since you can't legally drive with a busted windshield. You will have to get your windshield fixed one way or the other.

Schools here (well, the School District does) in FL have insurance (often called "Public Liability Insurance") for just those situations. Yours, I would imagine, would, too.

File the claim. And if they tell you to go pound sand, move up to District level (though, here in FL, you'd start at district level as the individual school has no ability to answer claims for damage) as Zigner said.
