Basement Leak

What is the name of your state? New York

During the recent rain storm our basement was flooded. The water came in from a crack that runs along where the cinder block foundation meets the cement floor. The crack is from the building settling over the years. The condo association is saying that we are responsible for the interior of the unit so we are responsible for this problem. In the condo associations agreement its states 'the associations insurance policy insures the exterior and structural portions of the building only'. We are willing to handle the repairs to the sheetrock and replacement of the floor but we want the condo association to fix the crack and to improve the outside drainage so this doesn't occur again.

From a legal perspective wouldn't a crack in the basement floor be considered a structural issue?
