I purchased my house in 2005 and in the first year of ownership there were multiple basement leaks. Most were resolved however one has persisted over the last four years and is still a problem. Additionally, water is seeping through the foundation starting about half way down but wasn't identified until about two months ago. A previous stain is present which indicates it has been leaking for sometime but has only just been found. My builder is very slow in responding to this problem and claims that the one year warranty is expired and he is no longer liable. If this problem was identified in the first year and has not been resolved doesn't he have a legal responsibility to fix it? How about the foundation leak? If it wasn't sealed properly shouldn't he get it resealed? I look forward to you answer. Thank you.

The GA SOL (Statute of Limitations) for construction defects is 4 yrs from substantial completion (O.C.G.A. § 9-3-30, also see Heffernan v. Johnson, 209 Ga. App. 139, 433 S.E.2d 108 ((1993))

Contact a local geo or structural engineering firm and have them review the specific problem and offer a PROFESSIONAL opinion as to the cause and resolution. If the opinion is that you have a defect, then you will need to contact a local attorney to represent you in contacting the builder.

is the basement built into the water table? Do you know what leel the water table is, do you have a well?
