To make a long story short, I have been getting 'payday advance' loans every 2 weeks for the past 2 1/2 years. Once I got in with them, I got stuck. They did not twist my arm to get a loan and I was stupid to ever go there but I did.
Anyway, I started off with a $100 loan paying back $125. Over the years, I have been 'upped' to currently getting $400 every 2 weeks and paying back $455. Their loan ammount is posted all over the store. The posts state 'Loans from $100 to $300'. Last year they told me that if I would write them one check for $345 and one for $115, I could then get $400. They said they couldn't do this for everyone and not to tell anyone they were doing this. Last month they tried to get me to get $600! They said I coud write the 2 checks for $345 each but not to tell anyone.
I lost my job 3 months ago and am now making a whopping $94 per week unemployment. We live in a very rural area and jobs are very hard to find around here. I have a wife and 3 children so $94 does not go far.
Three weeks ago, for the 1st time in over 2 years, I failed to pay them. I just plain didn't have the money and could not raise it. I was told that they were sending the check through the bank 2 times and if it didn't clear or I didn't bring them the money, I would be served with some type of warrant.
They have made THOUSANDS of dollars off of me over the years.
Is it legal what they are doing?
What will happen if I don't pay them back?
I can in no way forsee paying them anything until I get gainful employment. This may take a while. What can/ should I do?
I feel I owe them nothing and that I should be refunded some of what they have taken from me, especially since they are loaning me money that they are not supposed to and do not advertise that they do.
BTW. The company is called 'Advance America'. I have recently read some really bad things about them on some of my web searches.

Their threat of an 'arrest warrant' is THE method of threatening people who stop paying these loansharks - we've heard it all before here. I only wish ALL states would ban these places from operation !

They cannot have you arrested, not paying them is NOT a crime and neither is being unemployed with no money. You need to stop payment on the 'checks' that the payday place is holding to stop the vicious cycle you are caught in. They'll keep up with their threats of arrest and who knows what else they can think up. They could sue you, but that wouldn't happen overnight and it will cost them money to do so. I suspect that stuff about 'don't tell anyone we did this for you' is pure bullhockey, if the couldn't do it, they wouldn't.

Once you stop payment in the check(s), then you'll have to find a way to negotiate payment with them or whatever collection agency they hire.
