PLEASE HELP!!

Me and my roommate moved in to our apartment in May of 2004. All paperwork went through without a hitch and we've lived here in peace... until now.

Our in-house manager has told us that we are being evicted (per order of the property manager) because we are missing some kind of tax form stating wether or not our parents are claiming us on their taxes. She said if they are claiming us, then we're evicted and if they aren't claiming us, we're STILL evicted because the form for our parents 2003 taxes isn't in our file.

ARE YOU KIDDING ME?!?!?!

First of all, if all this is the case then we shouldn't have been allowed to move in in the first place because our parents DID claim us on their 2003 taxes. That would have prevented us from initially moving in. Second of all, she DID NOT give us ANY kind of papers about how our parents we're claiming. If so, it would be in out file because ALL paperwork is done IN THE OFFICE and cannot be taken out unless its the initial housing application.

Tell me how this is OUR fault and are we REALLY (legally) going to be made to vacate when all the landlord is doing is covering her butt so she doesn't get fired?? This can't be true!!

We moved here because we're in college. Its 15 minutes from our apartment. If we lived at home it'd be 1-2 hours one way everyday. We can't move back home and commute everyday.

We are not the only people she's done this to either. There's two more in this complex alone and theres one apartment shes vacating for the same reason in the complex where she resides.

Bottom line, she ought to be fired instead of kicking innocent people out on their butts for something SHE forgot to do. We should not have to pay..

PLEASE HELP ASAP!! Eviction is underway.. :confused:

Is any of this nonsense about dependants/taxes in the lease? If not, ask the LL to point to exactly which clause in the lease which they claim you breeched.

Otherwise, you are entitled to remain there until the expiration of the lease.

Thanks for your quick reply.

There was nothing in the lease about the tax status stuff. But there are clauses that appear a couple of times in the lease stating something about the LL or owners of the property reserve the right to revise the lease without contacting the tenant.

Heres the thing: The residing LL at the time was SUPPOSED to tell me that my roommate and I were to get something written and signed by our parents saying that they were not going to claim us on their income taxes. But she never told us this. That can't be proven of course.. but heres the kicker...

Since we were being claimed on our parents taxes and were allowed to move in anyway, that PROVES the fact that she didn't ask us for the paper or we would have never been allowed to move in. Doesn't that protect us?

Should we call HUD and contact the owner of the property?
