I filed for a change in custody and was granted temp sole custody. That was Oct 2003. After going back to court in Jan the judge said he needed all certified papers. No court since. The x asked to come get the child and take him out of state to visit family. I informed her that he could not leave the state (court order) and she said she would make a request through the courts.
Now to my question. Since she was served back in Aug 2003 does that mean that everything can just be scheduled in court from now on, or does she have to serve me because what she is requesting is different from the actual custody trial?

She will have to file a Motion in order for a judge to hear her request, and you will be notified. Unless, you have a court date set for the near future, she may take a chance on requesting the out of state visit at that time. A judge does not have to address the request unless it is properly filed, but may anyway.
