What is the name of your state (only U.S. law)? IN
When you are sued, you are notified, but not via certified mail. I was sued and according to the paper work the constable wrote down the description of my house but nothing else. No time the paper was left at my house, or if there was a car in the driveway or anything. I never got the paper, a judgement was placed against me. I am asking the judgement be set aside so I may have my day in court. I have never gotten anything on this case, or the levy placed against my bank account. The only reason I know it happened was when I checked my bank account to see if my car payment had cleared. When they told me what happen I then contacted the court clerk, went down and got copies of all the paper work.
If you are being sued, shouldn't you get it via certified mail or at least have it placed in your hand and have to sign for it when delivered by a constable? The letter sent to my bank placing the levy was certified mail....
