I am being sued in small claims court by an ex emplyoer, that had feelings for me, he is now stateing he has a signed document with my signature, i never signed anything, the document he says he has is for a loan of 500 dollars, i have no evidence other then e-mails that he states the only reason he i sueing is because he wants everyone to see how my current boyfriend treats me, he is also stateing he has me tape recorded saying that i will give him the money back, that is also a lie i have not seen this man for over 6 months, during the time i worked for he he had left gifts on my door from a vcr to a sterio and othe rlittle trinkets, and is asking for al of these things back because he has receipts, do i have to give gifts back? and how do i get any evidence to prove these things ? all i have are e-mails that he has sent.

please i need help

catina: Worst case scenario, you have to pay this man back $500; and, it wouldn't be a bad idea to send him an offer of a payment schedule and see if you can settle this out of court. That way you won't have a judgement against you on your credit file, etc.
Best case scenario, he decides not humiliate himself any further or more publicly, and you are free of the debt.
Reality check: You knew this man had a 'crush' on you and you accepted his gifts and his money. That wasn't the right thing to do, and I'm sure you know it. I think what this man wants is validation that you took advantage of his affections towards you; and admit it, you did. Apologize to him, face to face, give him the grace he deserves and acknowledge him as a person who is valuable, respectable, and kind, probably lonely and in need of someone to love him.
That's not unreasonable on your part, neither is it unreasonable for you to pay this man back his money, return the gifts, apologize, and leave the situation a wiser and more considerate woman and business owner. That is not the way to behave when you own a business. You must learn to say 'thank you, but I can not accept these gifts', etc. If you don't, it won't be just your business that gets a bad reputation.

Ok, you say should give him his things back, well i tried to return them , even so much as to take them back to his home, and what he sent via the mail i put return to sender. how can you make someone take items back when they just keep refuseing? he only wanted things back after he found out i had started dateing. i told him riht off the bat when he had asked me for a date, that i was not interested .
and i also did not go to his home anymore. so what else could i do? i really did'nt want to be rude but i guess that is what i should have done. right before he filed the lawsuit, i called and told him i would return or he could come and pick the things up. well he never came and told me not to bring them. I do not owe him a dime.

take all of the things he gave you to court, including the money. tell the judge you brought them to give to him, it's up to you whether or not to mention that you had tried to return them before.

That is a good idea. I was not sure if that was the thing to do or not. I will take the gifts he gave, but will not give him any money , he never gave me that money, But thanks for your help.
