My wife is being sued by Discover Card for $3,024.00. My first question is: What shoudl we expect to pay after the trial ?
MY RESPONSE: Okay, now you've completely changed/edited your original post. As for your "new" first question, the case probably won't get to trial - - unless it's filed in Small Claims court. If it's been filed in a court of greater jurisdiction, your wife will undoubtedly lose in a Motion for Summary Judgment, thereby bypassing a trial. You should expect to pay the entire amount, including interest, including court costs, and including attorney fees - - thus, raising the amount owed to about $5,000.00, or more.
How much of the debt do they need upfront ?
MY RESPONSE: I don't understand this question. "Upfront" for what? From your post, your wife is already being sued, and in order to "get rid" of the lawsuit, I imagine they want the entire amount, including interest, including court costs, and including attorney fees. However, there's nothing in the law that precludes a settlement at any time. Therefore, if you want to settle the claim, there's nothing that says you can't call opposing counsel to make an offer of settlement - - say, 50% of the total amount of the claim.
