Being sued for grandparent visitation

What is the name of your state (only U.S. law)? Illinois

My mother has become increasingly verbally and emotionally abusive to me over the years. Recently my husband and I decided that for the sake of our 16 month old daughter as well as our unborn child (currently 22 weeks pregnant), we could not continue a relationship with my mother. She causes nothing but stress and trouble. I have voicemails and emails saved that exhibit the extent of her harassment.

Yesterday she informed me via email that she is giving me one week to allow her to see our daughter (my mother lives in Iowa, we are in Illinois). If we do not respond, she is going to take us to court for visitation.

I have done research and am fairly certain that she has no case, as we are married and both wish to prohibit her from being our childrens' lives. Not to mention our daughter is young enough to have no idea who she is (she has seen her maybe on average once every two months) and she will not be negatively impacted in any way by not having her in her life. However, this is obviously extremely stressful and especially considering my pregnancy I am just looking for any confirmation or experience that anyone has with these laws in Illinois. I have contacted an attorney for a free consultation so that I can ease my mind but in the meantime, looking for any info that is out there.

i'm going to put my neck on the line....tell her to pound sand, kick rocks...and if granny files, make sure you request that SHE pay your attorney fees for wasting the courts time.

As an intact family, you and Dad can tell your Mom to pound sand. She has no rights (grandparents do not have any kind of inherent rights to the grandchildren).

Just a quick look thru the statutes makes me believe that the other posters are correct. She wouldn't have standing to sue in YOUR state as you are an intact family. If she attempts to sue in her state, file for a motion to dismiss due to lack of jurisdiction.
