Defending myself against State Farm as subrogee in Florida negligence suit (uninsured). I have answered both the complaint and the request for admissions. What happens next? It's been 30 days since if filed answer to req for admissions (denied negligence) and have heard or seen nothing since. Is there a time frame things happen in such as court setting date for trial? Does Plaintiff have to request court to set date for trial or does court do it autmatically? Also, I requested mediation w/answer to complaint. Do I have to set that mediation up or will court order it?

My response:

Depending upon what answers you supplied to the Requests for Admission will determine whether the insurance company moves for "Summary Judgment" or moves the case to trial.

I would suggest you get a book at your bookstore on the litigation process because it appears that you're "flying by the seat of your pants".

The court will eventually set the dates, unless the insurance company moves for Summary Judgment; in which case, they will set that date for the court.

The book will answer your questions, and help to guide you through the various steps required of you.
