MY PREVIOUS LANDLORD IS SUING ME FOR BACK RENT. INITIALLY THERE WERE 3 POEPLE ON THE LEASE. ONE PERSON MOVED OUT, NO NEW LEASE WAS DRAWN UP. HE WAS AWARE OF THIS AND EVEN LOWERED THE RENT SO THE OTHER ROOMMATE AND I COULD AFFORD TO STAY. I AM ON SOCIAL SERVICES AND MY RENT WENT DIRECTLY TO HIS RENTAL AGENCY. I HAVE PROOF OF THIS. I NEED TO KNOW, IN NYS COULD A LANDLORD STATEMENT,(WHICH SOCIAL SERVICES REQUIRES FROM THE LANDLORD, SIGNED), WHICH STATES THE PORTION OF MY RENT, BE USED AS AN AGREEMENT OR OVERRIDE THE LEASE? ALSO, HE DID NOT GIVE ME AN ITEMIZED DEDUCTION LIST AFTER I MOVED OUT AND I WOULD LIKE TO KNOW IF MY STATE'S LAWS REQUIRE HIM TO PAY ME DOUBLE MY SECURITY DEPOSIT? THANK YOU. That's an interesting question, Gem. There are reasonable legal arguments either way. The best people to talk to would be tenant's associations in NYC and/or your social worker. S/he may have run into this question before. You can look up NY laws in your library. I think the landlord tenant stuff is in the real property code. The code or association should also tell you if you get double or triple your deposit back.
