hi, we need some advice. my mother sold her house about 6 months ago. before she sold the house, she told the realtor that there were a few items in the yard she would be taking with her. a young couple bought the home, and they too knew that she was taking around 5 plants, and 2 water fountains. well, last friday, she was sued for 4,000.00 . this couple claimed she took, light fixtures, ceiling fans, window air conditioner, outside t.v. antenna, and apparently, 3,000 worth of landscaping. all of it is lies. they have no proof. she admitted to taking the fountains and plants, but that was because she told the realtor, and he apparently did not put it in the contract, and she understands this now, but they have indeed lied about everything else. in the contract it states "the provisions of this agreement shall be deemed to be merged ito the closing, except as to matters which are occasioned by clerical error or ommissions." does that mean that if the realtor forgot to put in the contract that she was taking something with her, that he has to see it as an ommission, and he has to fix it? there is so much to this story, for one thing we have just discovered that the landscaper that did the estimate on their property, didn't even go over there and look at it. they knew him well, and he done it as a favor, and he even said to a reliable source, that he wasn't recieving any money, because he wasn't doing the landscaping anyway. there is so much to this story, and i know i have typed so much already, but we know they are very behind on bills, and they need quick cash! they aren't even married anymore, they are divorced, but in court, they were saying they were married! they have lied so much!! should we appeal? we want to. there is no reason for us to pay these people, when they have lied since day 1. both have criminal records, and are well known around town about their evil ways. please we need some advice!!! thankyou

Bottom line is that this is so complicated no one on this board would be able to give you a "straight" answer on this scenario.

Find an attorney in your area. The best legal advice would be with someone knowlegable, ie. find an attorney.
