I AM SUING MY LANDLORD FOR MY SECURITY DEPOSIT AND A DOG DEPOSIT WHICH HE HASN,T RETURNED TO ME SINCE I,VE MOVED OUT. HE IS COUNTERSUING ME FOR "UNPAID RENT". I AM ON SOCIAL SERVICES AND MY RENT WAS PAID DIRECTLY TO HIM. MY QUESTION IS WHO IS RESPONSIBLE FOR UNPAID RENT WHEN THERE IS MORE THAN ONE,S PERSON ON THE LEASE?

Every person who signs the lease is responsible for the entire rent unless the lease limits the liability of one party. As I recall, the one time I encountered a tenant who got rent paid directly by the government, the landlord had to sign a gov't lease that supplemented the regular lease and limited the government's liability to the authorized monthly rent subsidy. If you had roommates, you need to drag them into the suit and cross-claim against them for the rent.

Did L send you a statement of deductions from the security deposit within the time limit established by state law? State law may require him to refund double your deposit if he didn't. This would nicely cancel out the alleged rent shortfall.

Go to your social services person and get copies of all payments they sent L, & copies of what you paid L. Get back to us with more facts (like your state) and more specific questions.

THANK YOU TRACEY, FOR YOUR RESPONSE. I LIVE IN NY STATE. NO, MY LANDLORD DID NOT GIVE ME A STATEMENT OF DEDUCTIONS OR OF ANY KIND AFTER I MOVED OUT. DO YOU KNOW IF HE IS LIABLE TO PAY ME DOUBLE MY SECURITY IN NYS BECAUSE OF THIS. CAN YOU TELL ME WHERE I CAN GO TO LOOOK UP LAWS FOR MY STATE? THANKS!

PS TRACEY! MY LANDLORD DID SIGN A LANDLORD STATEMENT BEFORE I MOVED IN (FOR SOCIAL SERVICES). IT STATED HOW MUCH MY PORTION OF THE RENT WAS. COULD THIS BE USED AS AN AGREEMENT? COULD IT OVERRIDE MY LEASE? THANKS AGAIN.
