Husband is being sued in Nevada for wrongful death. Auto wanted to settle for the limits, but now plaintiffs want to sue our home owners also. Wrongfull death conserning the entrustment of a vehicle is not covered under homeowners. Now the plaintiffs want to amend the complaint to include defamation and invasion of privacy in order to sue homeowners. They are asking $600,000 for the defamation and invasion of privacy. How can they make these claims with such a large amount at stake if we don't even live in the same town as them and have no contact with them or defamed them in any way. Basicly we believe this amended complaint is false. What are our chances of winning as far as the defamation and invasion of privacy is conserned.

Look, they want as much as they can get, and the policy limits under tha auto insurance may be insufficient to fairly compensate the family for the loss of the family member. And I don't know the facts to say if there is a possible defamation (which is very hard to prove) or any other grounds.

But usually defamation involves a VERY short statute of limitations. Tell your homeowners company and let it handle it.
