To whom it may concern:

I recently moved away for college. I moved into an apt. complex where i had a friend that was manager. I never filled out any aplications and i am unsure as to wither or not my mom co-signed the lease agreement with me.

I live in Alabama, and the law states you must be 19 to be leagally bound to any legal agreement. I am 18!

Shortly after I moved in, the place was foreclosed, and now the bank has sent agents in to handle the running of the place. If you can call it that! I have numerous problems since they took over that they say are not thier responsibility!
1)my bathroom sink leaked to the extint of totally
rotting the wood base of the sink
2)BUGS!!! out the wazzu! everytime i turn around there
seems to be a new species! (roaches, crickets, various
water bugs, centipedes, ect) When i reported the problem
they said i had to remind them every week to spray!!!!
3)flooding. 3 times my apart. has flooded:
a)water heater busted (took 1 1/2 months to fix)
b)children upstairs (left alone) turned water on,
flooding thier apt and min. My bathroom ceiling
caved partially in, walls and floored were stained and
musky. happened on thr. night 11pm. They placed note
on bthrm. door "Do NOT use, will be back Monday" so
they wouldn't be bothered by it on the weekend!
4)harassment. Several times i asked to see copy of my
lease. they refused, so i got my fiance to go with me,
they finally sent me some of it. when i called to
request the last few pages they refused. Later when they
came to change air filters and "spray for bugs" I again
asked with my fiance behind me. The agents wife was whom
we spoke with in a calm manner (other than metioning that
they would hear from my laywer) she ran to her husband
claiming we assaulted her! they theatened to call police
and have my fiance removed permantently from premises
then actually stated that he was threating my fiance!
(we filed charges)
5)destroyed my property: a)sanded ceilings to partially
repaint ceiling, but failed to cover my things (computer
desk and computer covered in celing grit), b) broke chair
while changing smoke detector. others to numerous to name, but you get the point!!!
Anyway the point is: are these grounds to terminate my lease with a 30 day notice?
Can I legally get a copy of my lease, without any expense?

exactly how do i need to go about this? They refuse to take my 30 day notice. They said i must stay for 2 months and repaint and clean the apt. thourghly before I move! The place wasn't even painted when I moved in!!
What actions do I need to take?!? They are being extremely uncooperative!

I would really like some more advice on the matter! Please?!?! I would like to know if I should just move and not say anything or if I should stay and put up with this crap another 5 months!

First of all you need to understand your legal rights and liabilities.
How can anyone advise you if you have not provided the foundation and facts.
Hint: Did your mother sign the lease? Do you have a fixed lease or are you m/m? Did you read the L/T laws? Who told you that you are not age of consent?

Based on the issues, you have grounds to terminate your lease. Such termination must be done legally and follow the L/T laws.

I do not remember if my mom signed the lease with me or not, and they refuse to let me see the one in their office or give me a copy. They refuse to take my 30 day notice, and they refuse to talk about it with me.

Another LL told me that you have to me 19 to be considered of legal age, unless you are married. And a family friend that is a retired lawyer.

I think you are wasting your money going to college.....

College is supposed to teach you to think,research facts, and solve problems, find answers and put it in writing.. and this is a problem.

Consider this the MOST IMPORTANT term paper you will ever write!

List all the facts....

Did mom sign the lease? are you of legal age? The college must have a library ? You are paying for it...so learn how to use it..

Also does your college have a law department, well go see a teacher and ask him to look up on Westlaw or Lexis state cases about your situation and READ THEM.....

You will learn far more about LIFE and our legal system when YOU delve into this,.. then you will ever learn in a college classroom!
