What is the name of your state? nm

I have a question maybe someone could clear up. I have 19 month old child her father is not in the picture, although he has tried to make contact. My question is he was to file for any type of custody I work app. 35-40 hrs. a week to support her and i am the one taking care of her. Would it look bad on my part if he wanted part custody and wasnt working as many hours as i am. I work for my parents company they are flexible with my hours so i get paid a steady pay but rearley work the full hours? please help clear up thanks

The father, as well as the mother, have equal rights to custody and visitation. The 'best interest of the child' is in most cases, the deciding factor.

Regardless, since you never asked a specific question, what exactly do you want this forum to do or say?

The law does not require a parent to make more money than the other parent in order to get shared custody and visitation. If a couple were married, and he didn't work at all, would he be prohibited from spending time with his child? Plenty of woman don't work at all and yet retain full custody. Do we apply bender bias and say that non-working moms are entitled to custody, but non-working dads should have no rights at all? You yourself state he HAS tried to get in touch. You can't put off the inevitable- if he wants involvement he will file and he will get some form of legal custody (once paternity is established) and visitation. Besides, why not give yourself a break, be fair to your child, and establish a legal visitation schedule that gives you some of your own time. Kids need BOTH parents! You are lucky- family business pays you a full week, even when you work part time, you say.

It took TWO of you to get to have a child! If he was shooting blanks you wouldn't get to be a mom to this child at all.
