I just got a letter in the mail threatening me that if I don't pay then they will take me to court.

We had out pool worked on by American Craftsman Pool and Spa, I signed a contract that stated they would be down with the work by June 15 of last year, they didn't start the work until August. I called them everyday and got no returned phone call. We payed the first half upfront. They did the work but did not do everything that the contract stated and still charged me for it. All the bills they sent me do not add up. When the finished the work they left a big mess and no one went over anything with me telling me what was finished and what they did.

I refuse to pay ...

1. they broke the contract by not finishing on the date stated

2. They are charging me for services they did no do.

My question is do they stand a chance in court or should I just pay it?

They probably stand a good chance of recovering some, if not all, of the money that they are claiming (if it is the correct amount).

You, however, will need to be able to PROVE that the work was not finished in time (and what it COST you, not just inconvenience) and PROVE that some items were not completed (and exactly what that will cost to fix). They will probably win what is left.

I would suggest that you get some written estimates to repair the incomplete or shoddy work that you are claiming.
