The collection agency, Belmont Financial is suing me. First they sent me a letter demanding payment on 5/7/04 . The letter was written on Belmont's letterhead and was from their Accounts Receivable Manager from their office in Wynnewood, PA. I ignored it. Then later I received a letter from a law firm in Bala Cynwyd, PA telling me that Belmont had retained this firm to collect the money I owed. Everything looked legal. It had the law firms letterhead at the top. On the bottom it had the "This is from a debt collector ,ect." I thought it was 2 different companys but it's not. I found out that Kenneth Shapiro is from Belmont Financial. Can a collection agency legally do this? They each have their own addresses and phone #'s. They made it look like it was the collection agency and a lawyer they had retained from a different company. Is this legal or not? TIA.

Yes, its legal - unfortunately. Its normal for them to send a case to an affiliate in your state/area to sue you or they will hire someone to sue on their behalf.

How old is the debt ? When did you last pay the original creditor ?
