Hi, we could really use some help with this.
We cannot afford a lawyer and are not sure how to proceed. We are in the state of Florida.
Here is what happened:
My boyfriend who is a disabled vet just found out there is a bench warrant out for him regarding his divorce case.
His Mom has been receiving his mail for him as he has been in fear due to threats from his ex's boyfriend. We are very poor and have not had a stable place to live and receive mail so his mom has been unable to forward it to us. We instructed her to open the letters, because we had nowhere to receive them and that is when we found out that there was a bench warrant issued for contempt of court.
The warrant states he did not sign some papers regarding signing over a time share which she was awarded and that he has to pay the court 800.00. He has opted to "go out on his own" as to not get me in trouble for being with me.
In the court documents his email is listed as a valid method of contact for her/her lawyer to contact him regarding the divorce only and no attempt was made to contact him regarding this matter via email. He has had the same email since 1997 and she has written to him at it many times in the past.
When she was unable to contact him via US mail she had her lawyer file comtempt charges rather than trying the alternate means of contact (email) to let him know that some papers needed to be signed.
He fears going to jail due to the threats on his life. He fears the person who made the threats will have someone in the jail attack him and him being disabled he will be unable to defend himself. He has no record and has never been to jail and the thought is terrifying.
We are not sure what to do. I sent an email to the state attorney explaining that he is more than willing to sign the papers, and would have had he received them (they were sent to his mom and we have not had an address for her to forward them to which is why we finally told her to go ahead and open them and let us know what they said), or known that there were papers waiting to be signed. And that furthermore she was to also sign over some property to him so why would he be unwilling.
In regards to the 800.00 I am not sure if it is a court fine or lawyers fees. Either way there is no way that we can afford to pay this as he is disabled and unable to work and we are homeless.
I am not sure how to get this warrant lifted. I fear that he will be arrested and hurt. I/We have no money for a lawyer and could use any advice help offered. I apologize if this is a bit disjointed as I am very scared and upset right now.
