My husbands father passed away in August. He had a $5,000.00 union death benefit. His will states that wife current wife receives $3,000.00 and my husband and his brother receive $1,000.00 apiece. The Union says that only the sons are listed as benificiaries. Are we legally obligated to pay his wife the $3,000.00 as stated in the will?

A: No; the insurance company must pay the beneficiaries. Life insurance proceeds normally do not pass through a dead person's estate.
