What is the name of your state (only U.S. law)? CA Well it is official Hell has frozen over!
Backstory might help some https://forum.freeadvice.com/search.php?searchid=3507454
I have as of the last week of Sep. started recieving CS payments.....it has been 6 years of NADA ZIP ZERO now out of the blue checks in the mail! I don't count on it lasting but at least I will be able to take Pretty to get her broken filling fixed soon:)
I just am just wondering what the O'l Mighty Sr's think of me requesting a review of the CS amount (if the checks keep comming for a few months)

Right now I am only working part time (due to health reasons) and I know he is making a lot more than the min wage that was imputed when our CO was made 6 yrs ago. Acording to the Ca Disomaster it could change things from Aprox $160 per mo to possibly $500 to $600 per mo. I just am not sure if I should risk Him requesting visitation again:confused:

Our Custody Order now states that I have Physical & Legal custody, he has no visitation and "Respondent (father) may petition the court in the future to pursue visitation rights; however Respondent will need to be able to demonstrate some sort of consistency when he files said petition to resuming visitation"
Pretty is 11 & 1/2 and has not had any form of contact with Him since she was 6 yo, prior to that 3 days of contact it had been 18 mo with no contact. She is well adjusted to Him not being in her life, it has been His choice.
I could really use the money but nor sure if it is worth wacking the hornets nest:eek:
Input please....as always good, bad or judgemental is welcome:cool:

No one can make that judgment for you.

If he's making a lot more than minimum wage, then you can request a CS modification and should get it.

OTOH, he has the right to request visitation. No one knows whether he'd do that if you asked for more CS, but you probably have as good an idea as anyone.

Bottom line, yours isn't a legal question and no one here can tell you what to do.

IMHO accept what you are getting. Wait to see if it continues. Reconsider your actions in a year, when he has an established pattern of paying. Many of the Sr's are ladies!:)
