Okay, now it has been 5 months and my back is still injured. My question is, is it really my insurance company that pays for my pain and suffering after a year? That is what my lawyer told me. Shouldn't it be the driver of the car's insurance company that pays my damages? Also, how do I get a doctor to admit that I have permanent damages whereas I would could get rewarded for the accident?

My response:
Greetings Licious:
You're not at fault, but the reason your own insurance is paying the medicals right now is so you won't be reported to a collection agency, and also, your doctors are entitled to be paid as soon as possible. The other person's insurance company doesn't have to pay for your medicals until they settle, or a judge tells them to pay. When they finally settle, or a judge renders a verdict in your favor, the insurance company will then pay for the medicals, and a sum of money to you for your pain and suffering (General Damages). Your doctor's medical reports will tell your attorney and the insurance company the extent of your injuries; e.g., permanent or otherwise.
Good luck to you and I hope you're feeling better.
