In march of 2004 my mother in law passed. The family atty had her removed from the deed leaving my father in law the only one on the deed. My MIL had a leased car with 2 years left on it and an american express card ($3,000 balance). She had no assets and both debts were in her name only. We turned in the lease within 30 days and explained she was deceased to American Express. In June of 2004 my father in law passed away. Only assests were the house (some equity) and some cash in HIS savings account. No other assets. Everything went thru probate and our atty is getting ready to file the final paperwork in probate to close it out.
Today a bill collector from American Express calls my brother in law (executor) and threatens to sue for his moms debt. She never had any assets and no probate was open for her. The probate was for the father. Can this company legally sue the estate even though she had no assets and the probate was open for his father only? Also, are the children responsible for the mothers debt in any way? Thanks in advance for your responses!!!
