Texas. My mother bought a car from my brother in law over a year ago. She's been asking him for the bill of sale in order to get it put in her name. He signed the title but still, no bill of sale. I called and asked him several times and each time he said he would mail it to her. Never did. Her tags have no expired (three months ago) and she cannot get them since the car is registered in another county. I go the title and insurance card, she carries him on there too since the car is in his name, went to the county where it's registered and found that he had placed what is called a Hard Stop on the car. From what I understand that is when a seller sells the car and the buyer doesn't have the title changed within the allotted amount of time and filing that gives him the right to go to another county and legally take the car back. He of course claims he didn't do that yet that's what they told me at the tax office and he's a major control freak so I know he did. I went to him, got a bill of sale and he put the wrong date on it. So now they tell her she can't get the tags because the dates are different on the bill of sale and the title. What can she do?

I am not a lawyer, but I do work at the motor vehicle division. And from what I know, the car is still legally his as long as he is listed as the owner on the title. He really doesn't need to do anything as far as trying to repo it, if he wanted to he could, and there is really nothing you can do about it.

There may be s law somewhere, but as far as motor vehicle is concerned, whoever is on the title, is the owner, thats it. At my job, we put a notice of sale on the terminal, to notify mvd that the car was sold, but, until the title is changed, it still belongs to the person listed on the title.


A question I have is, if you have the signed title, that isn't enough to transfer ownership? I know nothing about Texas law, but where I live just the signed title is good enough.

I wish I could be of more help, I would call an attorney to find out if I had any legal rights to the car. I went through a similar situation myself, and was told the exact same thing I just told you, but I do live in another state so maybe your laws are different. Good luck to you.:D

The told her that the only way to get the title changed over and get tags for the car was if she had a bill of sale. We got the bill of sale finally but he didn't put the same date on it as the date on the title when he signed it. For some reason here in Texas they want the dates to match. Makes no sense to me at all. I do appreciate your answering my post and I hate to have to pay an attorney for this but my brother in law has major issues with "control" and this is just how he is. It'll work out. I'm not one that gives up easily. Thanks again for replying.

Oddly enough this isn't my husband's brother. No kin to his side of the family. Sorry, can't give you anything to cut down there. Ugh.
