Bio Father Out of Country, Want Name Change

What is the name of your state (only U.S. law)? WA

2 Boys (10 & 12 yrs old)

Bio-Father has left the country 5 years ago wanted under drug charges. He stated he has No plans to return. He is married and started new family in Mexico. He also domestically assaulted boys mother, restraining order was in place as well as took older son on drug deals.

His family (grandparents) visit boys once a year. No contact with boys since he has left in person or by phone. Mother has remarried coming on 2 yrs January. Boys eagerly want name change to step father last name.

Would like to do name change but local court clerk advised that judge will not do anything without Bio-father's consent. We do not have an address for father to send consent request.

Dad needs to be served - don't his parents know where he lives? Is there are custody order?
