Still need some advice here, now since mom has dropped child to bio. father and given him a notorized statement that he has temp. custody we are trying to determine if we can draw up a custody agreement and file it with the courts to protect all concerned. There is still a legal father for the child who does not want anything to do with the child. The divorce with legal is from the state of Michigan but all parties are back in the state of Florida were all else took place. We will be checking with our court system to see if they have a packet to file custody this week so any information on laws in regard to filing custody between mom and bio. father would help. This is the third request on bio. vs legal and no one has any ideas. Even just your ideas may help lead us in the right direction. This has been going on for almost 6 years and this child needs a stable life and to get into school which mom has not done. We need to make the life of our child stable somehow. Thanks in advance

You mention a "legal" father. Does that indicate that you haven't established paternity for the child? I'd think you'd need to do that before petititioning the court for custody.

Yes paternity test were agreed to by the Judge based on motions filed to the court in Michigan were the divorce was done. We have a copy of the dna test showing the legal could not be the father and that bio.father is 99.89.
