What is the name of your state? Ca

I posted this in the bk forum, but I think it fits better here.

What is the name of your state? Ca

I filed chapter 7 last year after divorce and was discharged as of last July. I have not had anything late on my credit report in well over a year. I have disputed many items that did not state on my report that I went BK. I have disputed 3 times, 3 visa accounts with the same company and I "STILL" have charge off/written off on those accounts..as far up as Nov 2003. I filed 4/2003 and was discharged 7/2003. I have even mailed proof to the credit report agencies. Now what should I do? I am afraid all this disputing is going to hurt my report even more. I own a home, never have been late in 12 years. Car, never late. I just got left with debt from my ex and trying to start over with clean credit. Any advice? Score was 557 on one, and a LOW 490 on the other agency. I dont' get that one.

Disputing will NOT hurt your credit, its your right under the FCRA.

Sounds like its time for an intent to sue letter to Chase. The FTC clearly states that reporting a charge-off on an account that was NOT charged-off when you filed for BK is a violation of the FCRA.

Here's a link to the letter you should use as reference:

In our view, it is not a reasonable procedure to label an account that has been discharged in bankruptcy as "charged off as bad debt" if the account was open and not charged off when the consumer filed bankruptcy. Such a designation would be inaccurate or misleading, because it would indicate that the creditor had written off the account at the time of bankruptcy when it had not in fact done so.
If you'd like some inpur on how to write an intent to sue letter, head over to creditboards.com, they can help you with it.
