Blackmailed by neighbor, what are my rights

Hi I am a married mother of two children who is being harrassed and blackmailed by neighbor. First, she called the Dept of Natural Resources and Welfare office and reported child neglect on me and my husband, due to old appliances in back yard that have been located there for years, my husbands mother and father had these items before we took over the homeplace, in which never bother her before. Plus she reported that there was something wrong with our commode and sewer, having never been in our bathroom. All we had to do was clean the junk away to satisfy the dnr and the dhhs was satisfied that there was nothing wrong with our sewer, we even got a letter stating so. Second, my neighbor called the health inspector since she didnt get the response she wanted, well the health inspector came and stated there was no problem and went back and made his report stating so. She was inform of this, and got very angry and called the welfare system again.

The day before the welfare representative came she got into a screaming match with my husband and started with me. The is main concern of this question, this is what she stated to me, "pay 45,000 for my house or find someone who wants it, or I will call and report you everyday, till I get your kids taken away" Is this legal, can she make me threaten and scared to death everyday. I asked the welfare person who came today, which found nothing wrong, if she can keep calling in lies and abuse the system, and all he could tell me that if they recieve the same kind of call he would take care of it himself, but if she calls in different complaints everytime they have to check it out. Why is this person allowed to abused the system for her own good. She wants to move and wants me to pay for it. You see I have no 45,000 and know noone who wants it, but should I feel desperate to find one, Where are my rights? Why should my son have nightmares, which he has had since the beginning of this mess. Why should he have to run in the house when a car pulls up in fear it is the dreaded welfare system again. He is afraid to go to school, afraid I wont be there to pick him up. The welfare system has allowed this woman to impose mental abuse on my son, why is this allowed.

Do I have a case of anything against this woman or do I have to live through this abuse. How can I protect my family, PLEASE HELP ME!!!!!!!!!!!!!!!!!!!

Your rights are to have a suit against her for not just blackmail (which you can call the police about because it is a criminal offense) but also sue her for nuisance. That is a substantial and unreasonable intereference with your use and enjoyment of your home.


If you qualify for legal aid, as low income, then you should contact a legal aid foundation in your county and have them help you file a suit against her and have her brought up on criminal charges. Maybe the idea of her being arrested and actually being arrested may scare her enough to stop.
