I bought a boat from a private owner. The ad said $2800 in excellant condition. I received an e-mail from one of his family members that said he thought the boat leaked. I asked the seller if it leaked and he said no. I put the boat in the water and in 4 hours we were worried if we would make it back to the launch. I called him on it and he said "sorry". I sent him a demand letter and he never responded. Do I have any chance of getting my money back from him in small claims court on fraud. The boat did not represent what he was selling. If anyone has any information on this please help. Any questions I will answer promply. Thanks

Why didn't you check it out before purchasing? How can you prove that it wasn't fine when you bought it and now you damaged it and trying to look for a scapegoat? That will be his story. You have nothing at this point.
