Do you mean you lent somebody $2000 and they won't pay you back? And you wrote on the check that is a loan? Yes, I believe you should be able to sue, but it's probably a crap shoot as to what the judge will decide. I'd say you'd win but I've seen a lot of cases like these lose because the check alone may not be enough evidence of a loan. Did you make the other person sign a promissory note? Is there any other proof it's a loan, like anything on paper? Does the borrower say he doesn't owe the money or that he just doesn't have it to pay you back yet? Do you have the cleared check in your possession or can you obtain it?
