My boss sold me his 1994 Jeep Grand Cherokee for $5000.00. He said it was worth $7500.00 per Blue Book. He stated that certain parts were replaced or rebuilt and vehicle would be "AS-IS". I agreed to terms.
I would pay $250.00 per month. I paid $2000.00 so far. He also signed a Bill of sale showing that the vehicle is a "gift" and that I owe $0. So I would not have pay taxes to the state. I have a clear title to vehicle and I tried to get him to sign a statement that I would still pay the monthly installments but he refused. The problem is major mechanical problems started a month after I purchased the jeep and I discovered that he lied about the book value and the over all condition of the vehicle. He lost $500 of the
$2000 I paid and I have the cancelled checks. He also made this personal sale a company sale without my consent and now I have the company threatening to reposses the vehicle or take me to small claims because I have not paid for months because of the costly repairs and the jeep is still broken down collecting dust on my lot.. My questions finally is who is still the legal owner of this vehicle? And with a clear title that is in my possesion, am I still obligated to pay the previous owner and/or the company?
Update> Company took $500.00 out of my final paycheck and called it a "Repayment Of Bonus Advancement" In December 2004 I received a bonus of $500.00 that was also taxed. Bottom line they took the money for the Jeep. I filed against them with the Texas Workforce Commission and filed unrelated charges with the Texas Private Security Board.
