Very simply, my son was turning left and got hit by another vehicle passing the truck behind my son (this was a 2 lane highway). The county sheriff told me the other driver admitted that he started passing the truck behind my son when he started slowing down and did not see my son turning. My son was cited for "turning left when not safe" (we are going to contest the ticket) and the other driver was also cited, however the driver behind my son left the scene and has not been found as of yet. My insurance co. says that since my son was cited, that makes him partially responsible, and our insurance will pay damages to our truck (which will make our premiums go up more as we have 2 accidents on record with them). But why shouldn't the other ins. co. pay since their client admitted to illegal passing? Our agent says we can file a claim with/against the other ins. co. to get another investigation going. My question: what good will this do and how do we file a claim with/against the other insurance co? My son claims he had his left turn signal on, but when the vehicle directly behind my son left, there were no witnesses to verify the turn signal. My son is 16 and this was his 1st time driving alone and did have his drivers license with him. Thanks for any help/info you can provide.
