What is the name of your state? stonecold in n.y and I am wondering what to do. I recently answered an ad for an equipment trailer. after several conversations with the seller he agreed to bring the trailer to me several miles away so I might purchase it. we spoke at some length and he disclosed the trailer had new decking, new tires, new drop leg lift and new fender skirts. he also told me the trailer was rated 10,000 lbs and showed me the stamp on the tongue. I looked it over reasonably well and noticed it had passed nys inspection in nov/07. after conference call with my partner I decided to buy the trailer. the seller did not want to transfer his registration/plate but gave me a bill of sale and he signed the title over to me. he also followed me towing the trailer to my storage area before he took his plate off and we said our good byes. upon his departure I began really looking it over. first I hooked it to my truck and the breaks wouldn't work and digging into it found the wires disconnected. I also discovered the tires were not as heavily rated as I had thought, seems the axles are only 3,500lbs each (7,000 total) , and some of the trailer lights don't work. I called the guy and he says it's sold as is like the receipt I signed says. here's my inquiry: where do I stand? can I return the trailer and get my money back or am I stuck with this trailer?

ad stated those things correctly but what about what wasn't disclosed like the none working breaks, tires not as highly rated, light out. this thing seems to have passed a nys inspection back in nov/o7 and part of the reason I took some things on faith. I went to this guys house and he told me again that it was sold as is, he commented I looked it over for 30 minutes ( more like 15/20) but again it passed an earlier inspection. he adamantly asserted if I did not know what I was looking at/for I shouldn't have been the guy buying it.

Brakes are cheap - lights are cheap - tires can add up a bit.
How many axles does this trailer have?

tandem... 2 axles... tire are new D range... i'd thought they were E range
3,500 x 4 = 14,000 lbs.

As I said, check the internet - you can *replace* the brakes for under $200 total and the lights you can get either online of through a local trailer supply house for probably less than $50 total.

You have no case.

you're saying it's x4?? i thought the way its figured was each axle was 3,500lbs.. are you saying it goes by each tire and spring set??

Here's the thing .

You had a chance to hook it up and try it out before paying for it , and receiving a receipt that said " AS-IS " .

You do this before buying it , not after .

And there's really no misrepresentation in the Ad . Have you confirmed 7,000 ?

i think the ad said new E range tires and i have not confirmed axle weight. i did confront seller about that and inspection to which he stated.. he bought it as a 10k trailer and it obviously passed the inspection 7mo ago. he continued to say i didn't stamp the trailer or inspect it.
