I purchased a car for $1500 down and 300 a month for 7 months totalling $3950. (not including tax/tags). I thought i was getting a 1993 Ford Taurus Wagon with 77,439 miles. I did not know what the box "milage stated is in excess of its mechanical limits" meant at the time. However, i did explain to the dealer that i would not pay $4000 for a vehicle that had almost 200,000 miles on it. The dealer told me that the car had 77,000 miles on it and he wrote 77,000 on every paper he gave me, save the ODOMETER DISCLOSURE STATEMENT which he had checked the box i mentioned above. However. on the warrenty and tag application to the mva the dealer wrote "77,439" miles on the papers he gave me and "177,439" on the papers he turned in to the mva. No box stated the excess milage on these. Also, He scratched out a number before the 7 in 77,439 on my temp registration. I thought i was buying a car with 77,439 miles on it and so i signed the contract. Can I get out of the contract in small claims? (I spent $1300 fixing it) Can i get reimbursed for repairs and amount i paid for car? Do I need a lawyer? Do I have a case?
