What is the name of your state? Michgian

My mother had 40 acres, gave each daughter, (Me and sister) an acre to build a house with the understanding we would divide what is left minus the part kept with her house.
Mom had it surveyed in 1999 just prior to that my sister put up some fences where she thought the boundry would be. Mom diceided to keep 4 acres with her own house which threw it off where the boundry was going to be. Sister has fences over the boundry the whole length of the land ( which is long) If years go by is she legal to keep them there?
How many years does it take? Nieither me or my sister have put the left land in our names it is all in our mothers.

This doesn't make any sense. Was the original 40 acres ever properly subdivided?
