So this is an incident that happened 7 and half years ago, I bought an lcd monitor about 3 month after I came to the US with F-1 student visa (so it was in 2002), about 3-4 months of use I felt like my brain was damaged, in other words burned, I still feel my frontal lobe is damaged/burned. I lost sensitivity. Because I wasn't familiar with the things here and because for fear that someone else would be harmed I cut the cords of the monitor and threw it away, after a year I and my family moved to another state, there we bought another monitor this time a CRT monitor from another brand, and after months of use my situation started to get worse: I couldn't walk right, my left hand would become sweaty, I would have strange reactions, disgusting images would go through my mind etc. You don't imagine what I had to go through, people pointing their fingers at me and insulting me in the church and at work confusing me with something I wasn't. You know when your body is not in your control because it has reactions you don't want to have, but you are not like this? Even my parents insult me and till now I couldn't tell them what my situation really is. In the first years, I thought this was a burden I had to bear but I can't go on like this, It's been years and little have improved, and I don't thing it was karma either, I didn't do anything in the past to deserve this. My question is will I be able to file this case in court even though I'm overstaying my F-1 visa being that this incident happened when I was here legally.

Before you can file anything in court you will need a doctor's verification first, that your brain was damaged at all and second, that the monitor was the direct cause. You cannot sue on the basis of what you THINK happened.

(Other responders - sometimes the only way to get through is to take the story at face value.)

The statute of limitations for product liability in Florida is four years. Since the most recent injury by your account was six and a half years ago, you have waited to long to prevail in a lawsuit.

I've had mine for over 5 years and I haven't been abducted or had my brain melted by a Venusian Death Ray yet. The proof is in the pudding my friend.

Too coincidental to be believable for some I suppose. But it's the truth. It was one of the first models if not the first from that company being that lcds at that time wasn't as common as it is today as they were in the beginning stage.

What are the states that don't have such limitations also can I file this suit abroad like in the country of origin of that specific company?

Ok - let's be clear. You have NO CASE! The monitor didn't cause any damage to your brain. Period, even if.

Now, go get your tinfoil hat and place it firmly on your head. Then, find a corner and try to sit the rest out.

ETA: Oh, I should say...get your tinfoil hat and take it home to whatever country you SHOULD be in now - since you are not legal to be in THIS country.

If it happened in Florida, you're limited to Florida courts. You don't get to shop for jurisdictions because the SOL has expired.

Not to mention the fact that you are STILL going to have to have PROOF of the brain damage AND that the monitor caused it. You can't just go in and claim, this really happened, and expect everyone to take your word for it.

I have some extra tin foil from last night's bbq'd baked potatoes. Reuse~ Recycle...there was one more R word but I can't remember it.:)

I have no other word except that it'll make it clear for you only when you die, only then or maybe never.
