I have an interest in selling some t-shirts at a local flea market, lacoste/polo, etc. If I sell them as pre-owned items and also not as genuine manufacturer lacoste shirts does this avoid any copyright/trademark infringements?

Are the shirts genuine? If they are not, then you'll be facing liability for trademark infringement regardless of how you sell them, and could potentially be on the hook for criminal penalties as well.

If the shirts are genuine, and you purchased them from an authorized source, then you can resell the shirts without worry. If the shirts are genuine but NOT obtained through an authorized source, then you MAY still be able to sell them, but you may not be able to use the manufacturer's name or the designer's name to sell them.

There is a group that work all the flea markets in my area of Tampa, FL. they sell sunglasses advertised as basically knockoff's of brand name glasses. How is this possible or legal. Is it because they do not sell it under an advertised brand name sign or advertisement. because they must breaking trademark and copyright laws, right?

Most likely they just haven't been caught yet.
