Case: Can-Key Industries vs Industrial Leasing Corp.
I am a high school student and am participating in a 'mock trial' for one of my classes. I am the defendent in this trial, in which Rose A Linda tried four times to have a turkey hatching unit chagned to meets its specifications and she kept the unit for over 15 months. Can Key (the manufacturer of the unit) is suing Industrial Leasing Corp. (who is leasing the unit to Rose A Linda) for breach of contract. They state that ILC and Rose A Linda had accepted the hatching unit by keeping it so long in use, and by making alterations to it. I must prove that ILC and Rose A Linda did foilow the terms and conditions of the contract and that they did not breech any agreement with Can Key.
Please help me - my grade depends on it! This was tried in 1979, and I think it was in NY. Please help!
