I have what I hope is a quick question: Is an eBay Motors auction considered a binding contract in the eyes of the law?

Details: I bid on and won an auction for a vehicle on eBay Motors ($1825.00). At auction end I sent my deposit via PayPal, which was refunded by the Seller with the explanation that he had sold the veh. to another bidder.

I reported the Seller to eBay and left negative feedback, which, by-the-way, the Seller agreed in email that he deserved. He then left retaliatory negative feedback for me which I do not feel was justified. He insists that he has a "right" to leave me negative feedback because I left it for him.

I realize I have no material damages to claim, but do I have any case otherwise? My objective is to get him to remove the neg. feedback, although I'm prepared to go further if it's warranted.

FYI, I tried Squaretrade.com (no moderator) to no avail.

There really isn't any legal recourse available to you. If he left negative feedback for you just for retailiation to your negative feedback left for him, then you can always just reply to his negative feedback to you explaining the situation (That he left negative feedback just becuase you were unsatisfied with the service recieved). If you have mostly positive feedback from your other transactions, I would not worry too much about it.
