Per contractural agreement in February of 1999, I paid my wedding photographer $3000 to photograph my wedding and supply 40 pages of finished prints. I paid for his hotel expenses while he was in California (2 nights at $200 total) and I also paid $500 for additional prints (above and beyond the 40 pages included in our written contract). I have not received any finished prints from him. Per our agreement he had until February of 2000 to supply all prints to me. During this time, the photographer has closed his business and has taken employment in Germany. I have contacted him via e-mail to resolve this matter but have received no response, and I have no other information regarding his whereabouts. How can I proceed? I either want all the photographs I paid for (this is what I would prefer -it was my WEDDING by damn) or I would like to be completely reimbursed. HELP! I am heartbroken! Thank you.

My response:

Unless you want to sue him in the State and County where the contract was made and paid, then have him Personally Served with Process in Germany, then obtain a judgment, then seek and order to have the American judgment (assuming you prevail) translated into German, file the same with a German Court, and then hope and pray that a German court will recognize your American judgment, and then levy upon the defendant's property or bank accounts (assuming such property even exists or trying to find such property), you're pretty much out of luck. It could cost you many times more that your judgment (i.e., a lot more than the money you paid).

This is really a very unfortunate situation.
