After picking up the rent my landlord tells me the house is in a bank foreclosure and My family needs to be looking for a place to rent. A sheriff comes to the house with bank officials and told me they are there for a court ordered property survey. I asked why and a bank official told me the house has been under foreclosure since January and that I would be getting a notice to leave the premises. My lease is not up until November of this year. Can I sue my landlord for breach of contract and make him pay all the rent back to me that he has collected since the home was in foreclosure? Feedback please.

Why should you get to live there for free? You pay rent and in return got a place to stay.

The homeowner is screwing the mortgage holder, and the mortgage holder is getting back at him by taking the house away. Why do you want to get in between them with some silly "I want to live there for free" claim?

The notice to leave the premises is your cue that the lease is broken by the Landlord and that you are free to leave. You may also sue hum for damages, but you would have to have damages and you don't want to sue someone who is already broke.

The bad side....You need to move...NOW! You do not get paid for living there..even if it is in forclosure.

The bright side....You don't get penalized for breaching the lease... You do not have to try and find someone to take over the lease...And it is totally possible you can get your full deposit back.

BTW...Don't screw up the place....You know what I mean. You will get/be screwed if you do.

You could also talk to the bank and see if they will sell you the house. They are just going to sell it anyway and since you have a 7 year proven record of living there they may allow you to just stay while going thru the process. Banks are not real keen on holding property and will want to get rid of it as soon as possible. With the way the market is right now they could be holding it for awhile but if they know you are interested in purchasing you could get a good deal.
