I am a 16 year old teenager and
I have been wrongfully accused of breach of probation
I was arrested on February 26th 2009 on an allegation that i have been sending threats(via Facebook) to the victim who has a restraining order on me as part of the 18 month probation. On the disclosure it shows a different person who had sent the threats and the threats were made while i was at school so it couldn't be me. I am currently on house arrest until December 1st which is my trial date.

I know for a fact that i am going to plead not guilty cause of the sufficient evidence to prove it was not me

They took my phone for evidence
I have severe depression
stress/heart related issues all caused by the isolation of me in my home
i have been humiliated by being arrested inside my school for something i did not commit
I believe the police officer who arrested me did not have the proven grounds to make an arrest like that

Now i am wondering because of the negligence in the police investigation can i sue for malicious prosecution?.. because of the over weighing evidence that clearly proves it was not me who sent the threats?

Is there other matters which i can sue them for?

In the US, a no contact order will include you contacting through a third party. So if you told your buddy to post something to her on Facebook, then its a violation. No idea on Canadian Law though.

You need to prevail on the breach of probation action before you could consider suing anyone over this.

same thing my probation states you cant contact directly or indirectly
and i abide by those rules
this is the work of someone i do not know because it was a fake account on facebook
anyways thanks
