Hello:
I registered for a technical training class in NY, and attended a few classes (twice a week) for about 1 month 1 week. The class is divided into modules by subject and is supposed to be a 6 month class. Here is what happened:
I have several problems with this situation. 1) The teachers for some of these modules are AWFUL, have terrible communication skills, and were changed on more than one occasion at the complaint of myself and several other students. They seem the least qualified to even be teaching these courses, yet were hired to do so. I immediately at that point, about the 2nd-3rd week wanted a REFUND. They convinced me to stay, promising to change the teacher, and provide tutoring. Well, one was worse than the other, and when I sought tutoring, they absolutely did not have any available.
I got to another module, and MANY, MANY students dropped out of the class (b/c of the same reasons & terrible services provided by this school) I attempted to continue, and went to attend this module, and was told the CLASS was dissolved and canceled (there wouldn't be another one for over a month later)This was the last straw and I wanted to withdraw and get a REFUND (anything that seemed reasonable) - but of course, the Director of the school refused ANY refund....NOT ONE DIME!
I signed their "Refund" policy which states:
if withdrawal occurs:
1st week 100%
2nd week 75%
3rd wk 50%
4th 25%
after 0%
By the way, this is the only "contract" i signed, and it is completely one-sided, i.e. what their rules are, and doesn't have a terms of service or anything that i am entitled to.
Of course I was past their 4 week cutoff, but does this not constitute a BREACH OF CONTRACT!!! They cant even provide a teacher, and now even a class i paid for. Why should i be made to take a class in Jan-Feb (from teh begining) that I started in Oct?!!
This is BAD BUSINESS!! Indeed, I in good faith paid the amount in FULL, while other students paid $100 a week for class, and simply stopped payment when they dropped out. But is it fair for me to be penalized?? The refund policy also states Federal Title IV, which only applies to refunds for people who got financial aid.
He is so arrogant that he brags about being with in the law to keep the money. This is $2,000 dollars of my hard-earned money for the worst service I ever received. Do I have legal recourse, and what law or regulation can I use if I goto small claims court? Sorry for the long posting, but - PLEASE HELP!
