What is the name of your state? New York
Ok my problem is that I have a year lease up in July, and since myself and my husband have been here, we have tried unsuccessfully to get landlord to fix problems in the home. Some of them needed immediate fixing (which we did, and then did not even ask to be reimbursed), other things kept getting blown off time and time again (rotting doors, freezing shut doors, drafts in every window and door, ceilings cracking and falling and that is just a few) The landlord knows and has said time and time again that he will get to it, well here it is February and nothing is done yet. Now my husband and I are trying purchase a home and want out of the lease, are we able to use what he has NOT done as leverage to get out of it legally, or are we pretty much stuck? Landlord has already said no to getting out of it, is it worth to mention the "unfixed" things that he was going to fix before?? Any help would be great, and appreciated!! Thanks so much in advance for any good news!

**A: no good news. Read the NY L/T law as you needed to notify L in writing concerning the repairs.

First off, Landlord pointed out the problems TO us before moving in to house, and made a committment to have everything fixed prior to October 2004, and he didn't follow through. There was no need for anything to be in writing, Landlord pointed out problems on his own...and he still knows they need to be fixed. Secondly, Thank you for replying anyhow, we are getting out of the lease due to little bit of persuasion on my part, and landlord being in a good mood. Everything worked out great,and wish all other renters/landlords luck with all... :eek:

**A: ok, but had it been push comes to shove the L/T law would have favored L.
