purchased a cell phone and service for my son in november of 2001 as a gift to be given in december for christmas. within 7 days after he had the phone, it fogged up and quit working. i contacted the service provider and my son returned the phone. they exchanged the phone for another one. 2 months later, with februaries billing, we were automatically charged 80.00 for the phone. their explanation was that we had to have caused water damage to the phone because it would have never come from the factory like that. i maintain that we did not cause water damage to the phone. we are up against a wall. they say if we try to discontinue service we will owe them 200.00 because the contract says we must keep service with them for 1 year. i hate to pay 80.00 for something that i know we did not cause. if we pay the 80.00 we would own the phone but still have to stay with the service provider. is ther not a certain amount of time that a person can back out of a contract before it is binding. if i had know at the time that they exchanged the phone that we would be charged for it 2 months down the road. i never would have agreed to the service. any comments?
