My family and I just moved into a house approximately 3 months ago. We pay $1200 a month for rent and we gave $1200 for a deposit. Our lease agreement is for one year. Recently my grandmother has taken a turn for the worst. She is not doing very well and will probably require home care, which she cannot afford. She owns her own house, which is like brand new. What I have to think about doing is to move in with her so that my wife who is a Registered Nurse can take care of her. This would take care of the problem of home care. What I need to know is there any way that I can retain my deposit of $1200? I would love to stay here but my grandmother’s health is very important as well. We have kept the house in tiptop shape and have also repaired a lot of things ourselves. Is this going to be a case of the landlord being sympathetic to my situation or is there some kind of legality that I can go off of if she with holds my deposit for breaking the lease?

Oh boy.... are you in BIG BIG trouble far worse then a lousy $1200.

If you dont have your grandmoms house in your name or the kids name....that $1200 is the least of your worries.

Do you think your grandmom, can survive at least 3 years?

If not then all her medical bills will be combined and a lien will be put on the house and you will have to pay it all off, or they will force you to sell it. to pay the debt.

Ahhhhh what we dont talk about with our parents how to protect their assets at death.

As far as your $1200, talk to the landlord, ask him if you found acceptable tenants to sign a new lease so he wont lose any rent, then you should expect him to give you back you FULL secrity deposit. You will have to pay for an ad and show the apartment with the landlord, and make sure you get a check list and if you are moving far away and cant come back and sue him if he screws you, make sure you agree in wriing he will have a certified bank check NO PERSONAL checks. waiting for you when you hand him the keys.......

Thanks A bunch! I am not worried about the house it is payed off. That is the only major thing she has. So my biggest thing would be the $1200. Thanks for all of your help.

Well does she OR YOU have $20, 40 or $75,000 in cash stocks bonds to pay off her medical bills when it comes time to pay?

The bills have to be paid somehow....and the hospital will attach a lein to her house and when she dies it will have to be paid....

YOU will have to pay it by taking a mortgage on the house..OR it will be sold to settle the estate and you cant do a thing about it!

sorry kiddo.. thats what you really should be worried about!

You have 3 years to make sure she doesnt die, if you transfer the house today...So you should start praying she dies quickly and CHEAPLY......if not the kiss the house goodybe.
